GENERAL

1. The terms and conditions of this Agreement are binding on all Subscribers and a Subscriber shall also be deemed to have contracted with all other Subscribers and are bound by the terms and conditions of this Agreement.

2. These Terms and Conditions including the Schedules, contain the complete and exclusive understanding of the Subscriber with respect to the subject matter hereof and shall become effective upon ticking of the box below and submitting this subscription online by the Subscriber together with all the required information and supporting documents to COMPANY Sdn. Bhd. ("COMPANY") and approved by COMPANY via its email to the Subscriber. The date of COMPANY's confirmation email to the Subscriber shall be deemed as the "Effective Date".

3. COMPANY is entitled to reject an application from the Subscriber for the Services at its sole discretion without assigning any reason.

4. All prior representations whether made orally, in writing or electronically are hereby superseded. No waiver or amendment of any of the provisions hereof will be binding unless made in writing and signed by a duly authorized representative of COMPANY.

5. These Terms and Conditions may be amended by COMPANY from time to time by prior written or online notice to the Subscriber.

6. If any provision of these Terms and Conditions is held to be invalid or unenforceable for any reason whatsoever, such provision is deemed deleted and the remaining Terms and Conditions herein shall remain valid and enforceable apart from such provision.

APPLICABLE FEES & CHARGES

a) The Subscriber shall pay all fees and charges to COMPANY for the Services as per the price list listed at COMPANY. The fees and charges do not include applicable taxes, if any.

b) COMPANY shall invoice the Subscriber for payment of the Services provided and the Subscriber shall pay the full invoice amount within 30 days from the invoice date.

c) All payments shall be made to COMPANY via Payment Instrument in Ringgit Malaysia.

STORAGE OF DATA & TRADE DATA LOG

a) Each Subscriber shall maintain a complete log of all data sent and received. The information contained in such log shall not be modified in any manner whatsoever.

b) Each Subscriber shall maintain a Trade Data Log and all transmissions therein shall be stored for at least seven (7) years from the date a particular transmission is first received or transmitted by that Subscriber. COMPANY shall likewise maintain a Trade Data Log of transmissions received by it for a period of at least seven (7) years.

PERSONAL DATA PROTECTION ACT 2010 (PDPA)

a) COMPANY is committed to protecting the Subscriber's privacy as its valued customers and pledge to comply with the Personal Data Protection Act ("PDPA") 2010.

b) Any personal information ("Personal Data") in respect of commercial transactions that relates directly or indirectly to the Subscriber as an individual, that had been collected, processed and retained by COMPANY is protected under COMPANY's Privacy Policy, formulated pursuant to the PDPA 2010.

c) The Subscriber may refer to COMPANY's Privacy Policy at www.sffla.com.my to understand how COMPANY manages Personal Data.
